With reference to my letter of the 16th December

1931, the appeal in the action brought by the China

Navigation Co. Ltd. against H.M. Attorney General was

commenced on Monday, the 11th January 1932. After

argument, the appeal was adjourned on the 18th January

on the directions of the Court of Appeal who wished the

Admiralty and the War Office to furnish concrete

instances when, without authority based on statute,

payments had been received from any source, and

particularly from British subjects, in respect of

services performed. Both Departments furnished a

Memorandum supplying such instances and the appeal,

which was resumed on the 17th instant, was concluded

today, the Court reserving judgment.
